Written agreements during marriage?
My wife has filed for divorce and asked the court to consider our house as sole and separate property because she received a inheritance from her father before we bought the house. But prior to receiving the inheritance she made an agreement in writing stating that she was gifting me half of the inheritance. She now says she is withdrawing that agreement and wants all of our ets we purchased with those funds considered separate property. Can she do this? I have operated on the umption that the ets we purchased would be community property? After the agreement the money was placed in an account that we were both signers on and we are both on the deed to this house as well as our other ets. I feel like I am being robbed by her since she did not work for the last two years of our marriage and I solely supported her because she made excuses as to why she could not work. She says that even if the judge grants me half she intends to ask for spousal support as well. And we have no children from this marriage as well as the fact that she left months ago and gave me guardianship of her daughter.
